The Department of Homeland Security (DHS) recently adjusted the Temporary Protected Status (TPS) for Haiti. This change means some employers need to update their Form I-9 paperwork. It’s a good reminder for all employers to keep an eye on immigration policy updates and make sure their employee records are up-to-date.
Key changes to Hati’s TPS designation. On February 20, 2025, DHS Secretary Kristi Noem partially vacated the previous notice extending and redesignating Haiti for TPS. The key points of this amendment include:
- Reduction of the TPS period from 18 months to 12 months
- New expiration date set for August 3, 2025
- Employment Authorization Documents (EADs) with Category Codes A12 or C19 and a previous expiration date of February 3, 2026, now expire on August 3, 2025
Impact on employers. These changes have immediate implications for employers, particularly those with Haitian TPS beneficiaries in their workforce. Employers are required to:
- Review and update Form I-9 for affected employees
- Enter the amended expiration date (August 3, 2025) in the Additional Information field of Section 2
- Initial and date the correction
- Prepare for reverification of these employees before August 4, 2025
Form I-9 compliance. Form I-9 is an important document for verifying an employee’s identity and employment authorization. Proper completion and maintenance of this form are essential for several reasons:
- Legal compliance: It’s a legal requirement for all U.S. employers
- Avoiding penalties: Incorrect or outdated forms can lead to significant fines
- Non-discrimination: Proper handling ensures fair treatment of all employees
- Workforce management: It helps maintain an accurate record of workforce eligibility
Staying informed and prepared. This recent change in TPS designation for Haiti serves as a reminder of the dynamic nature of immigration policies. Employers should:
- Regularly check for updates from USCIS and DHS.
- Establish a system for tracking employee work authorization expiration dates.
- Train HR personnel on proper Form I-9 procedures and updates.
- Consider using E-Verify for additional verification support.
